‘Change law to bar MPs in educational instt’

The High Court on Sunday released the text of its verdict that declared two sections of the Governing Body and Managing Committee Regulations, 2009 illegal as those allow MPs to lead the managing committees or governing bodies of private schools and colleges,agencies report.

The court directed the education and law secretaries and the Dhaka Education Board to amend all the related laws in this regard through annulment of the sections 1,2 and 50 of the Governing Body and Managing Committee Regulations, 2009, within sixty days.

It also ordered holding election to the bodies of the schools and colleges through forming ad hoc committees within 30 days.

The court also asked for formulating a law providing appointment of the chief of the governing bodies of the private education institutions through elections. On June 1, the HC declared the two sections illegal.

A two-member HC bench comprising Justice Zinat Ara and Justice AKM Zahirul Hoque came up with the order after the final hearing on two writ petitions filed by adv Yunus Ali.

According to section 5 of the Governing Body and Managing Committee Regulations, 2009, an MP can be the head of the managing committees up to four private schools and colleges, and section 50 empower them to from a special committee in private educational institutions.

Both of the sections are contradictory to the constitution, said Yunus Ali. “Now private schools and colleges have to form managing committees through election,” he added.

On January 16, Yunus Ali filed a writ petition with the HC seeking the court order to abolish the special committee of Viqarunnisa Noon School & College headed by Civil Aviation and Tourism Minister Rashed Khan Menon.
